{"id":446,"date":"2019-09-03T14:54:33","date_gmt":"2019-09-03T06:54:33","guid":{"rendered":"http:\/\/aldrictinker.com\/?p=446"},"modified":"2019-09-03T14:54:33","modified_gmt":"2019-09-03T06:54:33","slug":"should-the-office-of-the-prime-minister-be-subjected-to-term-limits","status":"publish","type":"post","link":"https:\/\/aldrictinker.com\/?p=446","title":{"rendered":"Should the Office of the Prime Minister be subjected to Term Limits?"},"content":{"rendered":"<div class=\"\" data-block=\"true\" data-editor=\"ef0bs\" data-offset-key=\"bfjj8-0-0\">\n<h1 class=\"_1mf _1mj\" style=\"text-align: justify;\" data-offset-key=\"bfjj8-0-0\"><span style=\"color: #000000;\"><strong>Westminster Model<\/strong><\/span><\/h1>\n<\/div>\n<div class=\"\" style=\"text-align: justify;\" data-block=\"true\" data-editor=\"ef0bs\" data-offset-key=\"ffvcp-0-0\">\n<div class=\"_1mf _1mj\" data-offset-key=\"ffvcp-0-0\"><span style=\"color: #000000;\" data-offset-key=\"ffvcp-0-0\"><span data-text=\"true\">The Westminster Model, i.e. <em>sistem kerajaan perwakilan beparlimen<\/em>, does not prescribe such mechanics. Instead a prime minister and his\/her government will continue as long as:<\/span><\/span><\/div>\n<ol>\n<li class=\"_1mf _1mj\" data-offset-key=\"ffvcp-0-0\"><span style=\"color: #000000;\">S\/he remains a member of the elected house, and <\/span><\/li>\n<li class=\"_1mf _1mj\" data-offset-key=\"ffvcp-0-0\"><span style=\"color: #000000;\">S\/he commands the confidence of a majority of the members of that elected House. <\/span><\/li>\n<\/ol>\n<div class=\"_1mf _1mj\" data-offset-key=\"ffvcp-0-0\"><span style=\"color: #000000;\">Consider the cases of John Major, Gordon Brown, Kevin Rudd, and Atal Bihari Vajpayee among many. They left their office following a defeat in the general elections. Note that their defeat caused\u00a0their party failing to secure a majority seat in their elected house following an election. <\/span><\/div>\n<div class=\"_1mf _1mj\" data-offset-key=\"ffvcp-0-0\"><\/div>\n<div class=\"_1mf _1mj\" data-offset-key=\"ffvcp-0-0\"><span style=\"color: #000000;\">Or Kevin Rudd (1st Ministry) &amp; Margaret Thatcher who resigned following an internal party struggle.<\/span><\/div>\n<div class=\"_1mf _1mj\" data-offset-key=\"ffvcp-0-0\"><\/div>\n<div class=\"_1mf _1mj\" data-offset-key=\"ffvcp-0-0\"><span style=\"color: #000000;\">In the UK, successful votes of no confidence forced Stanley Baldwin (1924), Ramsay MacDonald (1924), and James Callaghan (1979) to [advise the Crown to] dissolve the Commons. Unfortunately, they lost the elections and were not returned to power.<\/span><\/div>\n<\/div>\n<div class=\"\" style=\"text-align: justify;\" data-block=\"true\" data-editor=\"ef0bs\" data-offset-key=\"70ms7-0-0\">\n<h1 class=\"_1mf _1mj\" data-offset-key=\"70ms7-0-0\"><span style=\"color: #000000;\">Federal Constitution of Malaysia<\/span><\/h1>\n<div class=\"_1mf _1mj\" style=\"text-align: justify;\" data-offset-key=\"70ms7-0-0\"><span style=\"color: #000000;\">In Malaysia this practice was codified into our Federal Constitution. A member of the Dewan Rakyat can be Prime Minister as long as 22 years or as short as 6 years. According to Art. 43(4):<\/span><\/div>\n<\/div>\n<div class=\"\" style=\"text-align: justify;\" data-block=\"true\" data-editor=\"ef0bs\" data-offset-key=\"eq915-0-0\">\n<blockquote>\n<div class=\"_1mf _1mj\" data-offset-key=\"eq915-0-0\"><span style=\"color: #000000;\" data-offset-key=\"eq915-0-0\"><span data-text=\"true\">If the Prime Minister ceases to command the confidence of the majority of the members of the House of Representatives, then, unless at his request the Yang di-Pertuan Agong dissolves Parliament, the Prime Minister shall tender the resignation of the Cabinet.<\/span><\/span><\/div>\n<\/blockquote>\n<\/div>\n<div class=\"_1mf _1mj\" style=\"text-align: justify;\" data-offset-key=\"eq915-0-0\"><span style=\"color: #000000;\">How do we know when the Dewan Rakyat is no longer confident in the Prime Minister?\u00a0Either one of this needs to happen:<\/span><\/div>\n<ol>\n<li class=\"_1mf _1mj\" style=\"text-align: justify;\" data-offset-key=\"eq915-0-0\"><span style=\"color: #000000;\">The Dewan Rakyat passed a Motion of No Confidence against the sitting prime minister; or<\/span><\/li>\n<li class=\"_1mf _1mj\" style=\"text-align: justify;\" data-offset-key=\"eq915-0-0\"><span style=\"color: #000000;\">The Motion of Thanks for the Royal Address was\u00a0defeated in the Dewan Rakyat; or<\/span><\/li>\n<li class=\"_1mf _1mj\" style=\"text-align: justify;\" data-offset-key=\"eq915-0-0\"><span style=\"color: #000000;\">The Supply Bill, a.k.a. Budget, was defeated in the Dewan Rakyat.<\/span><\/li>\n<\/ol>\n<h2><span style=\"color: #000000;\">How are these items defeated?<\/span><\/h2>\n<div style=\"width: 370px\" class=\"wp-caption aligncenter\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-large\" src=\"https:\/\/upload.wikimedia.org\/wikipedia\/commons\/3\/37\/13th_Dewan_Rakyat_of_Malaysia.svg\" alt=\"Composition of the Dewan Rakyat as at September 23, 2016.\" width=\"360\" height=\"185\" \/><p class=\"wp-caption-text\">Composition of the Dewan Rakyat as at September 23, 2016.<\/p><\/div>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The\u00a0<em>Dewan Rakyat<\/em> has 222 members.\u00a0For simplicity&#8217;s sake, let&#8217;s say everyone is present. A Bill\u00a0has to go through 4 stages: First Reading, Second Reading (with a vote), Committee Stage (with a vote), and Third Reading (with a vote).\u00a0When up for a vote:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">The Bill pass when 112 votes Aye and 110 votes Noe;<\/span><\/li>\n<li><span style=\"color: #000000;\">The Bill fails when 110 votes Aye and 112 votes Noe.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Again, this is if all 222 members are present and vote either Aye\u00a0or Noe. Sometimes members may abstain. Whichever vote that has the most, wins. For instance 86 votes Aye, 85 votes Noe, but 51 Abstains, the Bill passes.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The Dewan Rakyat needs at least 26 members present to form a quorum. So a Bill is passed when 10 of 26 present votes Aye, 9 of 26 present votes Noe, while the remaining present 7 Abstains.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">That is why the fanfare during the\u00a0Opening of Parliament and the Budget speech by the\u00a0Prime Minister. These are crucial Bills that needs the most support.<\/span><\/p>\n<h2><span style=\"color: #000000;\">So what happens when it is defeated?<\/span><\/h2>\n<div style=\"width: 379px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"\" src=\"https:\/\/upload.wikimedia.org\/wikipedia\/commons\/d\/de\/Kuala_Lumpur_Malaysia-Istana_Negara-Jalan-Duta-01.jpg\" alt=\"Istana Negara of Malaysia at Jalan Duta, the Official Residence of the Yang DiPertuan Agong of Malaysia.\" width=\"369\" height=\"246\" \/><p class=\"wp-caption-text\">Istana Negara of Malaysia at Jalan Duta, the Official Residence of the Yang DiPertuan Agong of Malaysia.<\/p><\/div>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The Prime Minister, under Art 43(4), has the right to seek an audience with His Majesty the Yang DiPertuan Agong. During that meeting, he\u00a0<span style=\"text-decoration: underline;\">requests<\/span> the King to dissolve Parliament. Note\u00a0that the King acts on the advice of the Prime Minister on many things.\u00a0When it comes to dissolving Parliament, Art. 40\u00a0(2) allows the Yang di-Pertuan Agong to\u00a0act in his discretion in\u00a0the withholding of consent to a request for the dissolution\u00a0of Parliament. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">So the King may reject the Prime Minister&#8217;s request? Yes.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Why? It is up to His Majesty. The King may have various reasons.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">And then what? The Prime Minister will tender the resignation of <span style=\"text-decoration: underline;\">the Cabinet<\/span>. Yes, it includes the Prime Minister himself.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Effectively, His Majesty &#8216;fired&#8217; the Prime Minister.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">However there is a potential problem:\u00a0<em>when<\/em> does the Prime Minister and his Cabinet resign? The Federal Constitution is silent. By expectation, it is immediately after the audience. However we have never seen this happen before in Malaysia.<\/span><\/p>\n<h1><span style=\"color: #000000;\">Back to the question on Term Limit for Prime Minister<\/span><\/h1>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"http:\/\/www.themalaymailonline.com\/malaysia\/article\/mukhriz-pribumi-will-moot-two-term-limit-for-pm\" target=\"_blank\" rel=\"noopener noreferrer\">Datuk Seri Mukhriz Mahathir<\/a>\u00a0(<span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.themalaymailonline.com\/malaysia\/article\/mukhriz-pribumi-will-moot-two-term-limit-for-pm\" target=\"_blank\" rel=\"noopener noreferrer\">Malay Mail Online<\/a><\/span>) stated that his party pledges to\u00a0impose a term limit on the Office of the Prime Minister of Malaysia. He cites that many countries are practicing term limits. This is a misleading statement. Yes, many democracies have term limits, but these democracies are not\u00a0<em>parliamentary democracies<\/em>.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Huh?<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Countries which impose term limits onto their executives are Republics with an elected, albeit directly or indirectly, Head of Government who also serves as Head of State. Countries like the United States (term limits for the President &amp; Governors), the Russian Federation (President cannot hold two consecutive terms; Putin-Medvedev swap), the People&#8217;s Republic of China, Botswana, Comoros, South Africa, and Iran.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Parliamentary democracies that have term limits for prime ministers, according to the Constitute Project (<span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.constituteproject.org\/search?lang=en&amp;key=hogterml\" target=\"_blank\" rel=\"noopener noreferrer\">Link<\/a><\/span>), are Andorra, Bhutan, Pakistan, Swaziland, and Tanzania.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The issue is not just about limiting the terms of the executive. Activists in the United States raise an interesting issue: limiting the terms of\u00a0<span style=\"text-decoration: underline;\">all<\/span> elected officials including and especially members of Congress. U.S. Term Limits (<span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.termlimits.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/www.termlimits.org\/<\/a><\/span>), a grass root movement, looks to end career politicians who over time fail to represent those that elect them.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Besides that, we must examine the mechanics of the prime minister&#8217;s\u00a0<em>support in the Dewan Rakyat<\/em>.\u00a0I support a fixed term Parliament. Like in the United States, Congressional elections are held on a fixed date, e.g. early November every second year, and the new Congress meets on January 3rd the following year.\u00a0However one must realise that this removes the Yang DiPertuan Agong&#8217;s authority to\u00a0dissolve Parliament. Elections will happen irrespective of the public sentiments surrounding the Polling Day.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Of course, the real question is &#8216;what happens next?&#8217;<\/span><\/p>\n<h2 style=\"text-align: justify;\">Have there been changes to the Westminster Model?<\/h2>\n<p style=\"text-align: justify;\">During Cameron&#8217;s\u00a0Coalition Government, Parliament passed the Fixed Term Parliament Act 2011.\u00a0The provision is similar to our Federal Constitution where Parliament automatically dissolves 5 years after the date of its first meeting.<\/p>\n<p style=\"text-align: justify;\">FTPA 2011 fixed\u00a0polling days\u00a0as &#8221;\u00a0the first Thursday in May in the fifth calendar year following that in which the polling day for the previous parliamentary general election fell&#8221; (Sec.1(3)) Any variation must be approved by Parliament.
